Welcome to the website of Tierra Learning Community (the "Site"). These Terms & Conditions ("Terms") govern your use of the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms address use of the website. Enrollment, tuition, attendance, and program-specific policies are governed separately by our enrollment agreement and school handbook, which take precedence over these Terms for matters of school operations.

1. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that could damage, disable, overburden, or impair it
  • Attempt to gain unauthorized access to any part of the Site, other accounts, or systems
  • Use automated means (bots, scrapers) to access or collect data from the Site without our permission
  • Submit false or misleading information through any form on the Site

2. Forms, Inquiries, and Enrollment

Submitting a contact form, inquiry, or enrollment application through the Site does not guarantee enrollment or admission. All enrollment is subject to review, availability, and a separate enrollment agreement between Tierra Learning Community and the enrolling parent/guardian.

3. Payments and Tuition

Where the Site allows for online payment of tuition, fees, or deposits:

  • Payments are processed through a third-party payment processor. By submitting payment, you agree to that processor's applicable terms.
  • All fees are due as outlined in your enrollment agreement or invoice.
  • Refund, withdrawal, and cancellation policies are governed by the enrollment agreement and school handbook, not by these Terms.
  • We are not responsible for payment processing errors, delays, or issues caused by third-party payment providers, your bank, or your card issuer.

4. Intellectual Property

All content on the Site — including text, graphics, logos, images, and course/program descriptions — is the property of Tierra Learning Community or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from Site content without our prior written permission, except for personal, non-commercial use.

5. No Professional or Educational Guarantee

Content on the Site is provided for general informational purposes about Tierra Learning Community and its programs. Nothing on the Site constitutes a guarantee of specific educational outcomes, admission, accreditation status, or suitability for any particular student. Prospective families should confirm current program details directly with school staff.

The Site may contain links to third-party websites or services (e.g., payment processors, social media platforms) that are not owned or controlled by Tierra Learning Community. We are not responsible for the content, terms, or privacy practices of any third-party sites.

This section does not limit any separate liability terms, waivers, or releases contained in your enrollment agreement, which govern in-person school activities and attendance.

You agree to indemnify and hold harmless Tierra Learning Community and its owners, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your misuse of the Site or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Hartford County, CT.

11. Changes to These Terms

We may revise these Terms at any time. The "Last Updated" date above reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

12. Severability
